Kenyan Man moves in court to stop the arrest of Kitutu Mp Richard Onyoka

A voter has appeared in court to demand the suspension of the arrest and indictment of Kitutu Chache MP Richard Onyonka for his hate speech in Kisii County.

Through his lawyer Danstan Omari, the man is also requesting a re-examination of the court to overturn any decision of the Director of Public Prosecutions to sue and sue the MP for this opinion.

“Therefore a restraining order is issued which prevents the defendants, either themselves or their agents, from arresting, bringing to court, prosecuting and / or prosecuting the first person responsible for the conclusion of questions or recommendations arising from phase 2 orders. Response 1 January 10, 2022 “read the argument.

Through Omari, the voter also alleges that the DPP’s directives to the IG copied to the NCIC to initiate an investigation are illegal and in violation of Act No. 12 of 2008 on National Cohesion and Integration Act.

“The order is a knee-jerk response, a popular figure and not a legal initiator as it violates the legal requirements of the law and the commission,” the petition read.
